Last Will and Testament

All estate plans start with a will. Some people do not think they need a will because they do not have a sizeable estate. Even if you only have a few simple possessions, having a basic will ensures that your personal possessions will be passed along as a remembrance to those you love. Having a specific designation of those you want your assets and belongings to go to can also prevent family feuds among grieving loved ones.

The beginning stage of estate planning is not expensive. A young family can start with a Last Will and Testament and Term Life Insurance, then update and upgrade with life changes. A well drafted Last Will and Testament will, at a minimum, include the following:

  • Naming an Administrator
  • Providing Instructions for Distribution of Assets
  • Naming a Guardian for Minor Children
  • Naming Someone to Manage the Children’s Inheritance

Whether you need a simple will or one that is more complex, it is important that your Last Will and Testament meets the requirements to be legally valid. At Good Grief Law, an attorney will meet with you in person, answer any questions you have and ensure that your wishes are set forth in a legally valid document.

If you need a last will and testament in Charleston, call us today.

A living will specify your wishes regarding advance health care directives.

Some people may require a more complex will prepared for you by a trusts and estates attorney. A complex will may be more appropriate if:

  • Your assets are valuable enough that estate taxes will apply.
  • You wish to establish a special needs trust for a child with a disability.
  • You want to set up a trust so that your children receive a certain sum of money at a particular age.
  • You have a previous spouse and/or children from a previous relationship.
  • You own a business.
